These Terms and Conditions constitute a legal agreement (“Terms”) between (i) “you” (the user) and Parihaar Healthcare Pvt. Ltd. (“we”, “us” or “”) in relation to the use of the Parihaar application and the services made available by or through. Please read these Terms and Conditions carefully before registering with, accessing or using the Parihaar mobile application. By accessing or downloading or registering with the Parihaar mobile application or by availing any of the services, you agree to be bound by these Terms and Conditions. If you do not agree to all or any of these Terms and Conditions, then you may not access, download or register with the Parihaar mobile application or avail any services through Parihaar.
Parihaar is a mobile application developed and operated by Parihaar Healthcare Pvt. Ltd., (hereinafter referred to as “Parihaar” or “the App”) which provides arthritis patients with consultation and advisory services from the various medical service providers (“Empanelled Providers”) and also enables Outcome based Care by them on a common platform,keeping the treating physician or Hospital at the center of these activities.The app provides these features to the registered users online access and connect them to their various medical service providers by on-boarding them onto the App. As a user of the App, you will have access to the following features, made available by Parihaar or by other third party service providers and facilitated by Parihaar (“Services”).
● Helpline feature that provides in between clinics support to patients on a subscription basis.
● In app consultation feature, where you can initiate a consultation through the app to your consulting Rheumatologist and / OR a designated doctor with whom you can share test reports, media files etc .
● Customized exercises and a schedule chart for the patient.
● Information on food and lifestyle that helps the patient set goals and receive tips.
● Features that enables patient driven adherence to treatment and tight control.
● Generate reports and complete periodic checks that can be shared with the doctor or used in an Emergency.
● Access to curated and custom made content from experts.
We reserve the right to modify or terminate any portion of the Terms for any reason and at any time, and such modifications shall be informed to you in writing. You should read the Terms at regular intervals. Your use of Parihaar following any such modification constitutes your agreement to follow and be bound by the Terms so modified.
On downloading Parihaar, you have a non-exclusive, non-transferable, right to use Parihaar on any Android™ device that you own or control. This right to use does not allow you to use Parihaar on any Android™ device that you do not own or control, and you may not distribute or make Parihaar available over a network where it could be used by multiple devices at the same time. Nothing contained in Parihaar or these Terms should be considered as granting you, by implication or otherwise, any right to use any trade-marks, logos, or other names contained in Parihaar. You may not rent, lease, lend, sell, redistribute or sublicense Parihaar. You may not copy, decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of Parihaar, any updates, or any part thereof (except as and only to the extent any foregoing restriction is prohibited by applicable law or to the extent as may be permitted by the licensing terms governing use of any open sourced components included within Parihaar) and you may not exploit the App in any unauthorized way whatsoever, including but not limited to, by trespass or burdening network capacity. You also agree that Parihaar contains proprietary content, information and material that is protected by applicable intellectual property and other laws, including but not limited to copyright, and that you will not use such proprietary content, information or materials in any way whatsoever except for permitted use of the App. Any attempt to do any of the above is a violation of the rights of Parihaar and its licensors. If you br/each these restrictions, you may be subject to prosecution and damages. These terms will govern any upgrades provided by Parihaar that replaces and/or supplements the original version of Parihaar, unless such upgrade is accompanied by separate terms in which case such separate terms will govern its use.
By downloading and registering with Parihaar, you represent that you are not barred by any law, in any jurisdiction or bound by any agreement that restricts your rights to access, download and register with Parihaar. In order to register with Parihaar, you will have to provide your mobile number, full name, gender, date of birth, address OP number assigned by the hospital and clinic and such other details as we may require from time to time through suitable advance notice. You will ensure that any information provided for registration with Parihaar are your own and do not belong to any third party and that they are valid and existing details.
You will solely be responsible for all usage or activity in your account after registration with Parihaar, including use of the account by any third party authorized by you. You will immediately notify Parihaar at [●] [admin@parihaar.in] of any known or suspected unauthorized use(s) of your account or Parihaar, or any known or suspected br/each of security. Parihaar will not be liable for any losses caused to you, whether directly or indirectly for any unauthorised use of your account or Parihaar or for your failure or delay to intimate Parihaar of known or suspected unauthorized use(s) of your account or Parihaar, or any known or suspected br/each of security.
You acknowledge, consent and agree that Parihaar may access, preserve or disclose your account information, through Parihaar or otherwise, including but not limited to personal information like mobile number, OP number, as well as related personal information, such as your name, address, mobile number, date of birth, etc., if required to do so by law or in good faith, believing that such access, preservation or disclosure is reasonably necessary to
(a) comply with legal process or the order of any Government authority;
(b) enforce these Terms;
(c) respond to claims that the registration information like mobile number violates the rights of third parties;
(d) carry out fraud verification of the credit/debit card details and other financial information provided
(e) respond to your requests for customer service; or
(f) protect the rights, property or personal safety of Parihaar, its users and the public. You acknowledge and agree that upon your registration and use of Parihaar, we and the third parties associated with us will collect, use, store and archive information about you in the following general categories:
● Personal information such as name, mobile number, gender, age, address and email.
● Sensitive information such as passwords, medical lab results information that you pass to our empanelled doctors, service about you or your dependants, information from the itemized bills of the doctors and financial information including but not limited to credit/debit card details.
● Information about your Parihaar sessions’ duration, pages viewed etc. to monitor the Parihaar application usage, to provide you with customized features and improve the services on Parihaar.
● Information about your mobile phone such as device type, operating system version, software and file version, mobile network information, etc. in order to facilitate the functions of the Parihaar application on your phone.
The collection, storage, use and sharing of this data by Parihaar will be in accordance with the Privacy Policy of Parihaar which can be found here PRIVACY POLICY.
3.1. We collect, directly or indirectly, and display on the App, relevant information regarding the profile and practice of the Empanelled Providers listed on the App, such as their specialization, qualification, fees, location, visiting hours, and similar details. We take reasonable efforts to ensure that such information is updated at frequent intervals. Although we screen and vet the information and photos submitted by the Empanelled Providers, we cannot be held liable for any inaccuracies or incompleteness represented from it, despite such reasonable efforts. You specifically agree and acknowledge that the App only enables you to access a listing and details of Empanelled Providers and accordingly we will not be responsible or liable for the credibility, reliability, or valid and lawful existence of such vendors.
3.2. Parihaar does not guarantee the accuracy or completeness of any content or information provided on the App. To the fullest extent permitted by law, Parihaar disclaims all liability arising out of your use or reliance upon the App, the Services, representations and warranties made by the Empanelled Providers, or any opinion or suggestion given or expressed by Parihaar or any Users in relation to any Services on the App.
3.3. Parihaar may be linked to the website of third parties, affiliates and business partners. Parihaar has no control over, and is not liable or responsible for the content, accuracy, validity, reliability or quality of such websites made available by/through Parihaar. Inclusion of any link on Parihaar does not imply that the App endorses the linked site. You may use the links and these services at your own risk, subject to their terms and conditions.
3.4. Parihaar assumes no responsibility, and will not be liable for, any damages to, or viruses that may infect your device on account of your access to or use of the App.
3.5. If Parihaar determines that you have provided fraudulent, inaccurate, or incomplete information, we reserves the right to immediately suspend your access to the App. You shall be liable to indemnify Parihaar for any losses incurred as a result of your misrepresentations or fraudulent information that has adversely affected Parihaar or its users.
3.6. The listing of any Empanelled Provider on the App or the results of any search you perform on the App for an Empanelled Provider should not be construed as an endorsement by Parihaar of such Provider. If you decide to engage with an Empanelled Provider to seek medical services, you will be doing so at your own risk.
3.7. Parihaar is not involved in providing any healthcare or medical advice or diagnosis and hence is not responsible for any interactions between you and the Empanelled Provider. You understand and agree that Parihaar will not be liable for:
3.7.1. your interaction with the Provider;
3.7.2. the ability, qualification or intent of the Provider;
3.7.3. any wrong medication or quality of treatment being given by the Provider, or any medical negligence on part of the Provider;
3.7.4. inappropriate treatment, or similar difficulties or any type of inconvenience suffered by you due to a failure on the part of the Empanelled Provider;
3.7.5. any misconduct or inappropriate behaviour by the Empanelled Provider;
3.7.6. cancellation or no show by the Empanelled Provider or rescheduling of booked appointments or any variation in the fees charged.
3.8. You understand and acknowledge that Parihaar does not in any manner endorse any Empanelled Provider and is not in any manner responsible for any drug/medicines prescribed or the therapy prescribed by such Provider.
3.9. In utilising the Services, you may receive communications through text messages, emails or calls, before or after the Service. Parihaar does not take any responsibility for such communications or its timelines.
3.10. Parihaar is merely a platform for the Services. Any interactions or associated issues with the Empanelled Provider, including but not limited to the user’s health issues and/or the user’s experiences is strictly between the user and the Provider. You agree and acknowledge that Parihaar will not be responsible for any such interactions and associated issues.
3.11. The Services are being made available to you as a platform to obtain ease of consultation from Empanelled Providers and does not intend to replace physical consultation with the Empanelled Provider.
The Terms will cease to apply to you in the following circumstances:
● When you delete your Parihaar account of your own accord or send an email to admin@parihaar.in requiring deletion of your account;
● When Pairhar ceases to make available the App with the provision of 30 days’ notice.
Note: Merely un-installing the App from your mobile device will not result in the deletion of your account or your information from the App and you will have to send an email to [admin@parihaar.in if you wish to delete all your account or your information from the Parihaar databases and servers.]
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF Parihaar IS AT YOUR SOLE RISK AND THAT THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY AND EFFORT IS WITH YOU. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Parihaar AND ANY SERVICES PERFORMED OR PROVIDED BY OR THROUGH Parihaar ARE PROVIDED "AS IS" AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND Parihaar HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE APP AND ANY SERVICES, EITHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS. Parihaar DOES NOT WARRANT AGAINST INTERFERENCE WITH YOUR ENJOYMENT OF THE APP, THAT THE FUNCTIONS CONTAINED IN, OR SERVICES PERFORMED OR PROVIDED BY, Parihaar WILL MEET YOUR REQUIREMENTS, THAT THE OPERATION OF THE APP OR SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN THE APP OR SERVICES WILL BE CORRECTED. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY Parihaar OR ITS AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY. SHOULD THE APP OR SERVICES PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON APPLICABLE STATUTORY RIGHTS OF A CONSUMER, IN SUCH CASES THE ABOVE EXCLUSION AND LIMITATIONS WILL APPLY TO YOU TO THE EXTENT PERMISSABLE BY LAW.
IN NO EVENT SHALL Parihaar OR ANY OF ITS SUBSIDIARIES OR AFFILIATES BE LIABLE TO YOU OR ANY PERSON FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL OR OTHER DAMAGES (INCLUDING, WITHOUT LIMITATION, ANY LOST PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION OR PROGRAMS OR OTHER DATA ON YOUR INFORMATION HANDLING SYSTEM) THAT ARE RELATED TO THE USE OF, OR THE INABILITY TO USE, THE SERVICES AND FUNCTIONS OF THE APP OR ANY LINKED WEB SITE/ MOBILE APPLICATION, EVEN IF Parihaar IS EXPRESSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
These Terms shall be governed by the laws of Republic of India without giving effect to its conflict of laws provisions. These Terms and Conditions shall be subject to the exclusive jurisdiction of the courts at Cochin, India.
If for any reason a court of competent jurisdiction finds any provision or portion of these Terms and Conditions to be unenforceable, the remainder of these Terms and Conditions will continue in full force and effect.
